1. Agreement to Terms

By accessing or using the services provided by Tutu Soetan ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

These Terms apply to all visitors, users, and others who access or use our career coaching services, website, or related materials.

2. Services Provided

Tutu Soetan provides professional career coaching and training services, including but not limited to:

  • Salary negotiation coaching
  • Personal branding and visibility strategies
  • Mindset transformation and confidence building

Services are delivered through one-on-one coaching sessions, group programs, online courses, and other formats as specified in your service agreement.

3. Booking and Payment

3.1 Service Booking

To book our services, you must:

  • Complete the booking form or contact us directly
  • Provide accurate and complete information
  • Confirm your appointment time
  • Review and accept the specific terms for your chosen service

3.2 Payment Terms

  • Payment is required before or at the time of service delivery
  • We accept various payment methods as specified during booking
  • All prices are stated in GBP unless otherwise noted
  • Payment plans may be available for longer-term programs
  • Prices are subject to change with notice

4. Cancellation and Refund Policy

4.1 Client Cancellations

  • 24+ hours notice: Full refund or session rescheduling
  • Less than 24 hours: 50% of session fee charged
  • No-show: Full session fee charged
  • Emergency situations: Handled on a case-by-case basis

4.2 Coach Cancellations

If we need to cancel a session, you will receive:

  • At least 24 hours advance notice
  • Full refund or priority rescheduling
  • Additional session credit for emergency cancellations on our part

5. Client Responsibilities

As a client, you agree to:

  • Arrive on time for scheduled sessions
  • Complete agreed-upon assignments and action items
  • Communicate openly and honestly during coaching sessions
  • Take responsibility for implementing coaching strategies
  • Maintain confidentiality of proprietary materials and methodologies
  • Provide feedback to help improve our services
  • Respect professional boundaries

6. Professional Standards and Limitations

6.1 Scope of Services

Our career coaching services:

  • Are professional development services, not medical, legal, or financial advice
  • Provide guidance and strategies but do not guarantee specific outcomes or job placements
  • Require active participation and commitment from the client
  • Are based on industry best practices and professional experience

6.2 No Guarantees

While we strive to provide high-quality coaching and have a strong track record, we cannot guarantee specific outcomes such as job offers, salary increases, or promotions. Success depends on multiple factors including your effort, market conditions, and individual circumstances.

7. Confidentiality

7.1 Coach Confidentiality

We maintain strict confidentiality of all information shared during coaching sessions, except:

  • When required by law
  • When there is an imminent threat to safety
  • When you provide written consent to share information

7.2 Client Confidentiality

You agree to keep proprietary coaching materials, methodologies, and intellectual property confidential and not to share or reproduce them without written permission.

8. Intellectual Property

All content, materials, resources, and intellectual property provided through our services remain the property of Tutu Soetan. This includes:

  • Coaching frameworks and methodologies
  • Training materials and course content
  • Templates, worksheets, and tools
  • Website content and branding

You may use these materials for personal use only and may not redistribute, sell, or claim them as your own.

9. Testimonials and Case Studies

We may request permission to use your success story, feedback, or testimonials for marketing purposes. You have the right to:

  • Approve or decline any testimonial requests
  • Review and approve content before publication
  • Request anonymity or use of initials only
  • Request removal of your testimonial at any time

10. Liability and Disclaimers

10.1 Limitation of Liability

To the fullest extent permitted by law, Tutu Soetan shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Lost profits or opportunities
  • Actions taken based on coaching advice
  • Outcomes of job applications or negotiations

10.2 Disclaimer of Warranties

Our services are provided "as is" without warranties of any kind, either express or implied. We make no guarantees about specific results or outcomes.

11. Termination

Either party may terminate the coaching relationship with written notice. Reasons for termination may include:

  • Completion of agreed-upon services
  • Breach of these Terms
  • Mutual agreement
  • Non-payment of fees
  • Incompatibility or lack of progress

Refunds for prepaid services will be provided on a pro-rata basis, less any non-refundable deposits or fees, unless termination is due to breach of Terms by the client.

12. Dispute Resolution

In the event of a dispute:

  1. We encourage direct communication to resolve issues amicably
  2. If unresolved, disputes shall be resolved through mediation
  3. Any legal proceedings shall be governed by the laws of England and Wales
  4. Disputes shall be subject to the exclusive jurisdiction of UK courts

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our services after changes constitutes acceptance of the new Terms. For existing clients with service agreements, changes will apply to future engagements.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
